Supreme Court to decide if it will consider Idaho property owners’ wetland appeal.

The Pacific Legal Foundation is bringing the case of an Idaho couple to the Supreme Court this month seeking review of an EPA decision to stop the couple from building a home on a lot due to wetlands designation. Lower courts have insisted that the couple undergo what is generally considered to be a fruitless administrative remedy before seeking judicial review. The case has become a poster-child for property rights groups that suggest that government regulation and bureaucratic control over property have gone too far.
