Minnesota property owners win appeal and stop eminent domain by development authority.

Eagan, Minnesota’s plans for its downtown hit a road block when the Minnesota Court of Appeals halted its attempts to acquire several businesses by eminent domai. The Court held that the authority to condemn was improper due to the lack of a “binding development agreement.” The city has condemned condemned 31 parcels for its Cedar Grove project, but 3 of them objected and took the case to the Court of Appeals. The first phase of the project will proceed without the 3 properties, according to city officials.
